Powerbond products are warranted to be free from defects in material and workmanship under normal operating conditions of recommended usage for a period of 12 months after shipment or 12,000 miles/19,200 kilometers of use, whichever occurs first. Powerbond’s liability under this warranty is limited to the purchase price of, at its option, the repair or replacement of any product which is determined by Powerbond to its satisfaction to be defective upon return to Powerbond, transportation charges prepaid, with Powerbond’s prior written authorization. This warranty does not apply to any product which has been improperly installed, maintained, or has been subjected to improper operation or use. EXCEPT AS EXPRESSLY STATED ABOVE, Powerbond MAKES NO WARRANTY, EXPRESS OR IMPLIED, WHETHER OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR USE OR OTHERWISE OF THE PRODUCTS, OR ON ANY PARTS OR LABOR FURNISHED DURING THE SALE, DELIVERY OR SERVICING OF THE PRODUCTS. IN NO EVENT SHALL Powerbond BE LIABLE TO BUYER FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR AS THE RESULT OF, THE SALES, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS OR ANY PART THEREOF, OR FOR ANY CHARGES OR EXPENSES OF ANY NATURE INCURRED WITHOUT Powerbond’S WRITTEN CONSENT. IN NO EVENT SHALL Powerbond’S LIABILITY UNDER ANY CLAIM MADE BY BUYER EXCEED THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT OF WHICH DAMAGES ARE CLAIMED, EVEN IF Powerbond HAS BEEN PROVIDED WITH NOTICE OF POTENTIAL LOSS.
