WARRANTY

• Ideal Clamp Products, Inc. warrants that the products: (a) shall conform to applicable standards, specifications, and drawings; (b) are merchantable; (c) are fit for the particular purpose for which such products are to be employed; (d) are free from defects in materials and workmanship; and (e) shall conform to any other express warranties Ideal Clamp Products may have made to the buyer. If Ideal Clamp Products is responsible for the design of the products, it warrants that such products will be suitable for use by the buyer. The buyer's written approval of designs furnished by Ideal Clamp Products shall not relieve Ideal Clamp Products of its obligations under this warranty and the company waives all defenses of lack of reliance. Notwithstanding Ideal Clamp Products’ standard warranty, all warranties shall extend for a minimum period of eighteen (18) months from receipt by the buyer or after the products are applied to their intended use. Ideal Clamp Products shall be liable for all damages both to the buyer and any third party as a result of any breach of warranty of any products.

• The warranties shall run to the buyer, its successors, assigns, and the users of the products. If any products are found to be defective during the warranty period then, in addition to other rights, remedies and choices as it may have by law, contract or at equity, the buyer at its option and sole discretion and at Ideal Clamp Products’ expense may: (a) reject and return such products for a full credit or refund; or (b) require Ideal Clamp Products to remove, ship and reinstall/reperform nonconforming products with conforming products. Any repaired or replaced products shall carry warranties on the same terms as set forth above. The foregoing warranties are in addition to any other warranties customarily made by Ideal Clamp Products and any implied warranties available by law.
